Uniting and Empowering Veterans through Camaraderie and Adventure

PLEASE READ CAREFULLY
THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS

1. Being at least 18 years old or has signed release by Parent or guardian for ages 12-17 (hereinafter referred to collectively as “Participant”).

2. Participant warrants and represents that he/she is in good health and there are no special problems associated with the care of the Participant and the undersigned parent or guardian (if applicable) has left no special instructions regarding the Participant.

3. Participant hereby assumes all risks which may be associated with and/or result from his/her
involvement in such Activity and releases and indemnifies WAYPOINT VETS (NON-PROFIT), and any 3rd party partners, affiliates, professional services, outfitters, and WAYPOINT VETS or 3rd party’s respective officers, directors, agents, servants, and employees (hereinafter will be referred to simply as “WAYPOINT VETS”) of and from any liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage or injury, including death, that may be sustained by me while participating in the Activity, including, but not limited to, those injuries and damages caused by the negligence and or breach of warranty, express or implied, on the part of WAYPOINT VETS.

4. Participant accepts and understands that activities hosted by WAYPOINT VETS can be considered dangerous and there may be risk involved. Participant agrees as a condition of being allowed to participate in WAYPOINT VETS activities that Participant freely accepts and voluntarily ASSUMES ALL RISKS OF PERSONAL INJURY OR DEATH or for property damage which results in any way from negligence,conditions on or about the premises and facilities, the operation of the activity including, but not limited to, necessary gear and equipment for the activity, actions or omissions of WAYPOINT VETS volunteers / Board Members or Participant’s participation in any activity hosted by WAYPOINT VETS. Participant understands that he/she will be held to assume the risk of all area conditions, situational risks, layout and obstacles, or natural occurrences uncontrollable by WAYPOINT VETS.

Participant assumes the risk of any injury to person or property resulting from any of the inherent dangers and risks of WAYPOINT VETS activities and may not recover from any WAYPOINT VETS volunteer / Board Member for any injury resulting from any of the inherent dangers and risks of WAYPOINT VETS activities including but not limited to: Changing weather conditions; existing and changing venue conditions; obstacles; anomalies; collisions with natural objects, man-made objects; variations in terrain; and the failure of participants to act within their own abilities. I acknowledge that leaving the retreat early will not result in any form of reimbursement.

5. By execution of this release WAYPOINT VETS shall be indemnified for any injury to other person(s) or property which Participant may cause as a result of engaging in the Activity. II understand that I’m participating in the Waypoint Retreat at my own free will. I acknowledge that by participating in the retreat I am not entering into a therapeutic relationship with any staff associated with the event or Waypoint Vets. I understand I am waiving any liability of any staff for any psychological or emotional stress that may arise through the course of the event. Intentionally or unintentionally I am aware that stressful emotions may arise during the event and it is my responsibility to seek professional services outside of the retreat if the need arises.

6. Participant authorizes WAYPOINT VETS and/or its authorized personnel to call for medical care for him/her or to transport him/her to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed for him/ her. Participant agrees that upon his/her transport to any such medical facility or hospital that WAYPOINT VETS shall not have any further responsibility for him/her. Further, Participant agrees to pay all costs associated with such medical care and related transportation provided for him/her and shall indemnify and hold harmless WAYPOINT VETS of and from any costs incurred therein.

7. PARTICIPANT CONTRACTUALLY AGREES that any and ALL DISPUTES between himself/herself and WAYPOINT VETS arising from his/her use of equipment and/or participation in the Activity OR use of equipment, and INCLUDING all claims for personal injury and/or death, WILL BE GOVERNED BY THE LAWS OF THE STATE OF TENNESSEE and EXCLUSIVE JURISDICTION thereof will be in the state of court residing in the county where the alleged tort occurred or the federal courts of the STATE OF TENNESSEE.

8. IN THE EVENT ANY SECTION OF THIS RELEASE IS FOUND TO BE UNENFORCEABLE, THE REMAINING TERMS SHALL BE FULLY ENFORCEABLE.

9. I hereby grant permission to Waypoint Vets and their associates to take and use photographs and/or video of me in publications, news releases, online, and in other communications related to the mission of Waypoint Vets and their associates.

10. This release shall be binding upon Participant’s assignees, subrogees, distributees, heirs, next of kin, executors, personal representatives, and administrators and may be pled by WAYPOINT VETS as a complete bar and defense against any claim, demand, action or causes of action by or on behalf of the Participant.

I HAVE CAREFULLY READ THE FOREGOING LIABILITY RELEASE, UNDERSTAND ITS CONTENTS AND SIGN MY SIGNATURE WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
